These general terms and conditions apply to any natural person wishing to reserve a room on the website www.suitescinabre.com. If the client disagrees with the terms of these general conditions, the reservation will not be authorized.
Article I. Definitions
GTC : refers to the following general terms and conditions of sale concluded between the client and Les Suites Cinabre.Client: refers to any natural person browsing and/or wishing to make a reservation on the website.Les Suites Cinabre : refers to the SAS Cinabre Art de Vivre with its registered head office at 14 Cité Bergère - Paris (75009) and identified at the RCS Paris n°949308555.Accommodation: refers to the Suites presented and offered for reservation by SAS Cinabre Art de Vivre on the website.Sojourn : refers to the period of the suite reservation during which the traveler has access to the accommodation.Website: refers to the Suites Cinabre website accessible at the following address www.suitescinabre.com.Reservation : refers to the reservation of a service by the Client on the website.Traveler : refers to the Client as well as any person benefiting from the Client's agreement and who will employ the accommodation. The Client guarantees compliance with the provisions of these general conditions by the Traveler.Concierge : refers to the natural person identified as the privileged contact person for the Traveler during the sojourn.
Article 2. Purpose
Les Suites Cinabre offers temporary accommodations for rent that are available for reservation through its website.These GTC aim to define the terms of use of the website by the user, the conditions for booking the sojourn as well as the rights and obligations of the parties in this context.The access and the use of the website are subject to compliance with these GTC. Therefore, any access and/or use of the website implies compliance with all the terms herein and their full acceptance by the user.The GTC are accessible all the time via the "general terms and conditions of sale" tab on the website, allowing them to be displayed on a separate web page.The use of the Website and the Reservation imply :The Client's knowledge and unconditional acceptance of these GTC and the Website's Privacy Policy.The Client's technical competence to use the website.The Client's understanding that the Reservation does not require a handwritten signature.The Client's acceptance of these GTC, materialized by checking a box named "I accept the general terms and conditions of sale in addition to the refund and cancellation policy" when making the reservation on the website.Les Suites Cinabre reserves the right to modify its GTC at any time. In the event of a modification, the applicable GTC are those in force on the date of the Reservation by the Client.
Article 3. Reservation
3.I. Reservation procedureThe reservation of a sojourn is performed on the website through the provided available form. The natural or legal person wishing to book a sojourn provides the desired dates and the number of Traveler(s).A sojourn must correspond to a minimum number of nights indicated on the website (2 nights).As the price may vary depending on the number of Travelers, the Client undertakes to provide information about all the intended Travelers for the sojourn and does so even if one of the Travelers is partially present during the sojourn. Les Suites Cinabre reserves the right to verify compliance with this provision, for instance by directly conducting checks on-site or by calling the Concierge in. Any false declaration in this regard will result, at the discretion of Les Suites Cinabre, in one or both of the consequences provided for in the Article 6.2 below.A child is considered as a Traveler under the meaning of these GTC over the age of two (2) years old.The Client selects one of the available accommodations for the desired dates.The accommodation page contains all the information regarding the residence and the sojourn, the total price of the sojourn, and an estimated price per night.To confirm the reservation, the Client must fill out the form displayed on the website, providing the following information : name, first name, email address, credit card details and if the wished payment method is to pay by credit card.If the Client wishes to use a payment method other than a credit card, the reservation must be finalized by contacting Les Suites Cinabre via the contact form on the website or by email at [email protected] validating the reservation request, the Client acknowledges having read all the information regarding the accommodation and the sojourn.
3.2. Security DepositDuring the reservation, a pre-authorization of a specified amount, indicated on the website at the time of reservation and depending on the capacity of the accommodation, will be placed on the credit card used for payment. The amount is blocked and not debited.The amount is released no later than 30 days after the end of the sojourn, after finishing inventory and inspection, with any deductions made for potential repair costs in case of damage or missing items.In case of default on payment, unavailability or discrepancy on the accommodation, the Client must make a report to the Concierge during the day after the arrival as intended in the agreed conditions in Article 7 of these GTC. Passing this time, the residence and its amenities will be deemed available and in good condition.In the event that the security deposit cannot be settled by credit card, Les Suites Cinabre will send a Stripe link to the Client for payment. The security deposit will be refunded within 7 days from the end of the sojourn, subject to any repair costs for damage or missing items.
Article 4. Price and payment terms
4.1. Price
The price of the Reservation is the current price indicated during the Reservation summary accessible before confirming the Reservation.The price is set at the full discretion of Les Suites Cinabre and may be subject to modifications and variations over time, particularly based on reservation periods.The price is inclusive of all taxes (VAT and other applicable taxes on the day of the Reservation, excluding the tourist tax). The price applies per accommodation for the number of Traveler(s), according to the chosen booking method and selected dates. The tourist tax must be paid directly on-site upon check-out.
4.2. Breakfast
Breakfast is not included in the price. Please contact us in advance if you want to order breakfast.
4.3. Payment Terms
If the Client makes the reservation within fourteen (14) days before the start of the sojourn, the full price of the sojourn must be paid at the time of the reservation.The reservation is confirmed by email upon receipt of full payment.
If the Client makes the reservation more than fourteen (14) days before the start of the sojourn, twenty (20) percent of the total price of the sojourn must be paid at the time of the reservation. The balance will be automatically charged to the credit card provided during the reservation, fourteen (14) days before the start of the sojourn.
The reservation is confirmed by email upon receipt of the first installment. In the event of non-payment of the second installment within the specified period, Les Suites Cinabre reserves the right to cancel the sojourn reservation, without the Client being entitled to a refund of the first installment.
Payment can be made, at the Client's choice, by the following means of payment:Credit card (Visa, Visa Debit, Mastercard, Discover, JCB, American Express),PayPal,Bank transferThe Client wishing to pay via PayPal or bank transfer must contact Les Suites Cinabre to finalize the reservation, using the contact form on the website or by email at [email protected].
In the case of a payment by bank transfer, the Client must provide proof of transfer to Les Suites Cinabres, who will confirm the reservation upon receipt of the funds.
Article 5. Cancellation and Modification
5.1. Reservation cancellation termsThe Client is informed that, in accordance with Article L 221-28 12° of the French Consumer Code, the right of withdrawal cannot be exercised for contracts "for the provision of accommodation services [...] to be provided at a specific date or period." Therefore, the Client does not have the right of withdrawal provided by the Consumer Code for the reservation of accommodation.
It is possible to cancel and refund the sojourn reservation up to fourteen (14) days before the start of the sojourn. Beyond this period, a reservation cancellation will not be eligible for any refund. Les Suites Cinabre will refund the Client using the payment method used during the reservation.
In the event of unavailability of the accommodation after the reservation is confirmed, Les Suites Cinabre will inform the Client via email as soon as possible. The reservation can then be canceled or modified by the Client if another accommodation is available.
5.2. Reservation modification termsThe Client can request to modify their reservation until fourteen (14) days before the start of the sojourn by contacting Les Suites Cinabre via the contact form on the website or by email at [email protected]. Les Suites Cinabre undertakes to make every effort to accommodate any request to change the dates made by the Client.
Article 6. Internal Regulations
The Client agrees to comply with the internal regulations of Les Suites Cinabre. The Client agrees to use the accommodation and the website in accordance with their intended purpose, good morals, and public order. The Client is responsible for ensuring that all Travelers comply with the provisions of these regulations.In the event of non-compliance with the provisions of this article by the Traveler, Les Suites Cinabre reserves the right to terminate the sojourn, without the Traveler or the Client being entitled to claim compensation or refund for this.
6.I. MinorsLes Suites Cinabre cannot accommodate unaccompanied minors under the age of 18. Therefore, Les Suites Cinabre reserves the right to request any proof of identity to verify compliance with this provision. In case of violation of this provision, Les Suites Cinabre will cancel the reservation without refund or immediately terminate the sojourn. Minors under the age of 18 are under the sole responsibility of their legal representatives throughout the sojourn.
6.2. Number of TravelersThe number of Travelers must not exceed the number provided during the reservation and must not exceed the maximum capacity indicated on the website. Les Suites Cinabre reserves the right to verify compliance with this provision, for instance by conducting on-site checks. Any false declaration in this regard may result, at the discretion of Les Suites Cinabre, in the application of a penalty equivalent to twice the rate per undeclared Traveler for the entire duration of the sojourn, or the cancellation of the sojourn without advance notice.If the Client wishes to add a Traveler, within the maximum capacity of the accommodation, they must obtain prior authorization from Les Suites Cinabre, who reserves the right to request payment of an additional cost.Parties or gatherings are strictly prohibited in the accommodation. If the Client wishes to invite people who are not listed as Travelers to the accommodation, they must obtain prior authorization from Les Suites Cinabre.
6.3. SmokingSmoking is strictly prohibited in the accommodation, including in the common areas of the building. Les Suites Cinabre reserves the right to deduct three hundred (300) euros from the Client's security deposit in case of odors due to smoking. Any damage caused by smoking will be deducted from the security deposit.
6.4. PetsPets are not allowed in the accommodation.
6.5. Use and damage to the accommodationThe Traveler agrees to respect the premises and make reasonable and appropriate use of the accommodation and the facilities provided during the sojourn. Any missing items and any damage to movable and immovable property will be deducted from the security deposit, and if necessary, a request for compensation for the entire loss suffered by Les Suites Cinabre will be made. The Traveler agrees not to engage in any commercial activity within the residence. The Traveler agrees not to establish as the principal residence the address of Les Suites Cinabre for tax purposes, professional purposes, or to lend, sublet, or otherwise grant the suite to a third party.
6.6. Internet accessThe accommodations have internet access available via WiFi. The Client is responsible for the proper functioning of any personal computer equipment and the Internet access. The Internet access is for personal use only, in compliance with the current applicable laws and the intellectual and artistic property. The Traveler is responsible for the proper use of the Internet access and indemnifies Les Suites Cinabre against any action or claim brought by a third party as a result of their actions, particularly on the Internet network. Les Suites Cinabre disclaims all liability in case of malfunction of the Traveler's equipment or incompatibility of the equipment with the available Internet access service in the accommodation.
6.7. Arrival and departure procedureCheck-in at the accommodation is possible starting from 4:00 PM (16:00) on the first day of the sojourn. The arrival details are sent by email to the Client, who is personally welcomed at the Cinabre boutique at 14 Cité Bergère on the day of arrival, especially for the key handover.If no Traveler arrives by midnight (12:00 AM or 00:00) on the first day of the sojourn without informing Les Suites Cinabre, Les Suites Cinabre reserves the right to cancel the sojourn reservation without refund, except for cleaning fees.The last day of the sojourn, the Traveler must vacate the residence by 11:00 AM (11:00). The Traveler must return the accommodation without damage and in an orderly manner.Upon departure, the Traveler returns the keys to the accommodation to the Concierge. Les Suites Cinabre reserves the right to deduct one hundred fifty (150) euros from the Client's security deposit if the keys have not been returned to the Concierge by 12:30 PM (12:30) on the day of departure, unless prior agreement has been reached with Les Suites Cinabre for a delayed departure.In any case, if the Traveler does not return the keys by 2:30 PM (14:30) on the day of departure, Les Suites Cinabre will charge an additional night at the average price of the total nights of the sojourn.The Traveler agrees not to remain in the accommodation after the end of the sojourn.
Article 7. Claims and Questions
The Concierge is available to assist the Traveler throughout the sojourn and answer any questions. The Concierge's contact details are sent via email along with the hours during which they can be reached.In the event of any defect or non-compliance with the accommodation or its amenities, the Client must notify the Concierge on the day of arrival. Beyond this deadline, the accommodation and its amenities will be deemed to be in good condition and in compliance with the reservation.
Article 8. Guarantees
8.1. LiabilityLes Suites Cinabre disclaims all liability for direct and indirect damages suffered by the Traveler or caused to third parties by the Traveler during the sojourn. In particular, Les Suites Cinabre is not responsible for:thefts, damage, or loss of personal belongings owned by the Traveler or others, present in the accommodation,damage caused to vehicles parked in external parking spaces, including those recommended by Les Suites Cinabre or the Concierge to the Traveler,nuisances, including noises, caused by third parties to the Traveler, which may disrupt, interrupt, or hinder the sojourn.Les Suites Cinabre does not offer a mail delivery service within the accommodation.
8.2. Force MajeureThe liability of Les Suites Cinabre or the Client cannot be sought if the execution of the reservation is delayed or prevented due to a case of force majeure or a fortuitous event, whether caused by the other party, a third party, or external causes such as social conflicts, intervention by civil or military authorities, natural disasters, fires, water damage, interruption of the telecommunications network, or power grid.
8.3. Limitation of liabilityIn any case, the liability of Les Suites Cinabre towards the Client for any claims arising from these terms and conditions, the reservation of a sojourn, or the use of the website is limited to the total amount paid by the Client to Les Suites Cinabre for the reservation of the sojourn. It is understood that the claim must have been made within the legal prescription period.
Article 9. Modifications
Les Suites Cinabre reserves the right to update the website and services at any time.Les Suites Cinabre reserves the right to modify the terms, conditions, and provisions of these terms and conditions at any time. They may also be supplemented by new contractual conditions, especially in the event of technical, legal, or jurisprudential developments, or when implementing new services and features.
Article 10. Hypertext links
Les Suites Cinabre specifies that the use of hypertext links may lead the website user to other independent websites or applications. Hypertext links established to other sites or applications from the website cannot, under any circumstances, engage the responsibility of Les Suites Cinabre.Likewise, the insertion of hypertext links to website entirely or partially is authorized, on a non-exclusive and revocable basis at any time, without Les Suites Cinabre having to provide any justification, provided that the link does not create a misleading, false, derogatory, or harmful representation of the website. As part of this authorization, Les Suites Cinabre reserves the right to object.Les Suites Cinabre cannot be held responsible for any direct, indirect, or incidental damage resulting from access to or use of information from third-party websites.
Article 11. Intellectual Property
Every element present on the website, as well as the website itself, is protected by copyright, trademarks, design rights, and/or any other applicable law.These elements belong to Les Suites Cinabre or are used with the permission of the rights holders or in accordance with applicable law. They may only be used for private, personal, and non-commercial purposes. Their use must also be in compliance with the reproduced elements. Therefore, no modification or alteration of any kind can be made to them. Any use for purposes other than those listed above must be done with the prior written authorization of Les Suites Cinabre.The use of website content in contravention of these provisions constitutes copyright infringement under the French Intellectual Property Code.
Article 12. Independence of Clauses
If any part of these terms and conditions is deemed null, invalid, or unenforceable for any reason, the term(s) in question shall be deemed null and void, while the remaining terms shall retain their full force and effect and continue to be enforceable. The null and void terms shall then be replaced by terms that most closely resemble the content and meaning of the annulled clause.
Article 13. Dispute
In the event of a dispute, the Client should first contact Les Suites Cinabre by email ([email protected]) or by postal mail (14 Cité Bergère – 75009 Paris, France).If the claim is unsuccessful or no response is received within a period of two (2) months, the Client may submit the dispute to a mediator (Association des Médiateurs Européens) in an attempt to reach a solution independently and impartially. The Client can use the mediator's website (here) to submit a mediation request.The Client and Les Suites Cinabre are free to accept or refuse the use of mediation to settle a dispute, as well as to accept or refuse the solution proposed by the mediator.In the absence of an amicable agreement, the competent court to resolve the conflict is the court of the defendant's domicile or the place of execution of the reservation.If desired and independently of any other procedure for resolving the dispute with Les Suites Cinabre, the Client may use the following online dispute resolution platform offered by the European Union :https://ec.europa.eu/consumers/odr/main/index.cfm?event=main.home.chooseLanguageThese General Terms and Conditions are subject to French law.In the event of difficulties in interpretation arising from a contradiction between the French version and any other version in another language, only the French version shall prevail.
Article 14. Final Provisions
These GTC will remain fully effective regardless of any changes to the structure and legal personality of Les Suites Cinabre, including mergers, acquisitions, or divisions, with or without the creation of a new legal entity.Unless expressly provided otherwise, these terms and conditions express the entire agreement between the parties. They cancel and replace all other verbal or written agreements of any kind that may have been previously entered into between them relating to the same subject matter.Any reservation implies the full acceptance by the Client of the terms and conditions of sale and use.
